These Terms and Conditions govern the use of https://www.bellaschippy.com and our mobile application, and the sale of all goods ordered through them. They form the basis of the contract between you and Bellas Chippy. Our Website/Application will guide you through the ordering process, and you can review and amend your order before submitting it. Please check your order and read these Terms carefully before you submit it. If anything is unclear, please ask us before ordering.

Definitions

• "Takeaway", "We", "Us", "Our" means Bellas Chippy, Unit 2 Craggs Road,NE338FB;
• "EatAndRepeat" means EatAndRepeat, whose registered office is at Unit 1a, The Yard Mill Pit, Shiney Row, DH4 4RA. EatAndRepeat operates this Website/Application on behalf of the Takeaway;
• "Website" means https://www.bellaschippy.com;
• "Application" means the Bellas Chippy mobile application you use to place food orders.

Our contract

1. All orders are subject to availability and confirmation of the order price. To place an order you must be over 18 years of age and hold a valid payment card, or choose another payment method we offer. We may refuse any order.
2. When you place an order you will receive an acknowledgement by email, SMS and/or on screen. This acknowledgement does not mean your order has been accepted. A contract between us is formed only when we confirm that your order has been accepted.
3. When placing an order, you confirm that all details you give us are true and accurate, that you are an authorised user of the payment card used, and that there are sufficient funds to cover the cost of your order.

Pricing and availability

1. We try to make sure all details, descriptions and prices on our Website/Application are accurate, but errors may occur. If we find an error in the price of goods you have ordered, we will tell you as soon as possible and let you either reconfirm your order at the correct price or cancel it. If we cannot contact you, we will treat the order as cancelled and give you a full refund of any amount paid.
2. Delivery charges, service charges and any bag or packaging charges are added to your order. They are shown clearly at checkout and included in the total cost before you pay.

Payment

Online card payments are processed securely by Stripe. When you place your order, your card is authorised for the order total, and that amount is taken as full payment for the goods you have ordered. Where cash on delivery or collection is offered, payment is due in full when you receive your order.

Delivery and collection

Delivery and collection times are estimates only. Neither EatAndRepeat nor the Takeaway can guarantee an exact time, but we will try to deliver or have your order ready within the time given when you ordered. Times may be affected by demand, weather, traffic or other events outside our control. Please make sure someone is available to receive a delivery at the address given.

Cancellations and amendments

Food is prepared to order, so once your order has been accepted and payment taken you cannot usually cancel it or receive a refund. If you need to change or cancel an order, please contact the Takeaway as soon as possible on Call Now - 0191 417 8687. We will try to help, but we cannot guarantee your request can be met if preparation has already started.

Refunds and charge-backs

1. If there is a problem with your order, such as missing or incorrect items, please contact the Takeaway straight away. Any refund is at the Takeaway's discretion and will be made to the original payment method.
2. Card refunds usually take 5–10 working days to appear on your statement, depending on your bank.
3. If you see a transaction you do not recognise, please contact us using the details below before raising a charge-back with your bank.

Allergens and food information

If you have a food allergy or intolerance, please contact the Takeaway before ordering on Call Now - 0191 417 8687 to ask about ingredients. Although care is taken, dishes are prepared in a kitchen where allergens are present, so we cannot guarantee any item is completely free from allergens. Menu descriptions and images are for guidance only.

Feedback

If your order does not meet your expectations, you can leave feedback through our Website/Application. Feedback may be reviewed and displayed at our discretion.

Complaints and compensation

1. If you are unhappy with the quality of the goods or service provided by Bellas Chippy, please contact Bellas Chippy directly on Call Now - 0191 417 8687 so they can resolve your complaint.
2. If you cannot reach Bellas Chippy, or they do not deal with your complaint, you can contact EatAndRepeat customer support on 0191 510 1618 or at [email protected] within 48 hours of placing your order. We will contact the Takeaway on your behalf. Please note that EatAndRepeat provides the ordering platform only, and has no control over, and no liability for, the quality of the food or service provided by the Takeaway.

Third-party links

Our Website/Application may contain links to third-party websites or services that are not owned or controlled by EatAndRepeat or the Takeaway. We have no control over, and accept no responsibility for, their content, privacy policies or practices. We are not liable for any loss or damage caused by your use of any such content, goods or services. We advise you to read the terms and privacy policies of any third-party site you visit.

Termination

We may suspend or end your access to our Website/Application immediately, without notice, if you breach these Terms. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Privacy Policy

Your use of our Website/Application is also governed by our Privacy Policy, which forms part of these Terms.

Variation, invalidity and waiver

1. We may change these Terms, and our services or any page of our Website/Application, at any time. Changes will be posted on this page. If a change is material we will try to give reasonable notice before it takes effect. The Terms in force when you place an order apply to that order.
2. If any provision of these Terms is found to be unlawful, invalid or unenforceable, it will be removed and the rest of these Terms will remain in full effect.
3. If you breach these Terms and we take no action, we remain entitled to use our rights and remedies in any other situation where you breach them.

Law and jurisdiction

1. These Terms, and the relationship between you and us, are governed by the laws of England and Wales.
2. If you are a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
3. Any dispute relating to these Terms will be subject to the jurisdiction of the courts of England, Wales, Scotland or Northern Ireland, depending on where you live.
